Terms of Service

These Terms govern your use of zappyquote.com and the Zappy studio (the “Service”). The Service is provided by ZappyQuote Digital, trading as Zappy AI Studio, Komorni Hradek 416, Chocerady 257 24, Czech Republic. In these Terms, “Zappy”, “we”, “us” and “our” refer to ZappyQuote Digital trading as Zappy AI Studio. By using the Service you agree to these Terms.

Eligibility and accounts

You must be at least 18, or the age of majority where you live, or have the consent of a parent or guardian. You are responsible for activity under your account and for keeping your credentials secure.

Credits and plans

The Service uses credits to meter generation. Free accounts receive a daily allowance of credits that refreshes each day and does not roll over. Paid plans provide a monthly or annual credit allowance as described on our pricing page. Credits have no cash value, are not transferable, and are not redeemable except to use the Service.

Payments and cancellation

Paid plans are billed in advance on a recurring basis (monthly or annually) through Stripe and renew automatically until cancelled. You can cancel at any time from your account; cancellation stops future renewals, and access continues until the end of the current billing period. Except where required by law, payments are non-refundable.

One-time credit purchases

Some credits are bought once rather than by subscription. A top-up adds credits to your account as a single purchase, and the starter pack is a one-time offer limited to one per account — neither is a subscription and neither renews. One-time credits do not change your plan: buying them does not start, upgrade or cancel a subscription, and they do not expire at the end of a billing period the way a plan’s monthly allowance does.

Developer access

You may create API keys for your own account where the developer surface is available to you. An API key is a secret that acts as your account: keep it server-side, never publish it, and rotate or revoke it yourself if you think it has been exposed. Revocation takes effect immediately. A key is shown to you once, when it is created — we store only a hash of it and cannot show it to you again or recover it for you.

You may also authorise an application to act on your account through OAuth. What an application may do is limited to the permissions you approved on the consent screen, spending is never granted unless you approved it, and you can revoke any connection at any time from your account. Reusing an authorisation code or a refresh token revokes the whole connection, because a credential arriving twice has leaked.

The daily and per-request limits on a key are spending ceilings on your own balance. They are not an allowance, not a quota and not free credits: they bound what a credential may spend of what you already hold. Spending through the API, through the MCP server or through an authorised application requires qualifying purchased or subscription credits; free, daily and promotional credits are for use in the Studio and cannot fund developer requests.

We may rate-limit, suspend or disconnect a key or an application that is abusing the Service, and we may change or withdraw developer access. We will not do so to an account acting in good faith without telling you.

Invitations and referral rewards

You can invite other people to Zappy with your own referral link. If someone who joins through your link makes their first qualifying purchase, you can earn 100 bonus credits.

• The reward is issued as promotional credits for use in the Studio. It is not cash, not a commission and not an affiliate arrangement, it has no cash value, and it cannot be transferred or redeemed for money.
• One reward per referred account, for that account’s first qualifying purchase only. Later purchases by the same person earn nothing further.
• A reward is not immediate. It is held for at least 72 hours after the purchase so that reversals and abuse can surface (longer if it needs review), and it is issued only after that period if the purchase still stands.
• Referring yourself does not qualify, and an account can have only one referrer, fixed when the account is created. It cannot be changed afterwards.
• If the qualifying purchase is later refunded, disputed or charged back, a reward that has not yet been issued is cancelled, and one that has been issued may be withdrawn. A partial refund counts only when it leaves less than half of the purchase paid for; a purchase that still has at least half of its price paid keeps its reward.
• Rewards are earned only from invitations made after the programme starts. Purchases made before then do not qualify.
• We never show you who signed up through your link or what they bought; you see only counts.
• We may withhold a reward pending review, and we may suspend, change or end the programme. Credits already in your account are yours; ending the programme does not take them back.

Acceptable use

You agree not to use the Service to create or distribute content that is illegal, infringing, deceptive, or harmful, including content that violates others’ rights, sexualizes minors, or is intended to harass or defraud. In particular, you may not use avatar, headshot, or voice features to impersonate a real person without their consent. You agree not to attempt to bypass credit limits, rate limits, or security measures, or to resell the Service without authorization.

To report content or an account that you believe violates these Terms, email support@zappyquote.com with a link or description. We review reports and may remove content or suspend accounts.

Your content and outputs

You retain your rights in the images and text you provide. Subject to these Terms and to the terms of the underlying AI models, you may use the outputs you generate; paid plans include a commercial-use license as described on the pricing page. You are responsible for ensuring you have the rights to any content you upload and for how you use the outputs.

Third-party models

Generation is performed by third-party AI providers. Their availability, behavior, and results are outside our control, and outputs are provided on an as-is basis.

Disclaimers and liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Zappy is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the Service in the twelve months before the claim.

Changes and termination

We may update these Terms or the Service, and we may suspend or terminate accounts that violate these Terms. Continued use after changes take effect means you accept the updated Terms.
